GAGA PHOTOGRAPHY STUDIO

It is understood that the following terms and conditions are a fundamental component of this agreement and that no changes to it can be made without the written consent of Gaga Photography Studio (also known as "the Studio" or "the photographer(s)"). By scheduling and paying for your session at Gaga Photography Studio, you consent to be legally bound by the terms and conditions outlined below. All photographers and staff members of Gaga Photography Studio are collectively referred to as the "Studio," as is the company as a whole. The term "Client" refers to the client or clients and any additional people present during a photo shoot with any Gaga Photography Studio photographers.

Payment Terms:

​

A non-Refundable Deposit of the Session Fee is payable for booking & reservation. Original Photographs are released post clearance of full outstanding.

Cancellation Policy :

The Studio is aware of the difficulties and concerns each of us has in light of the Covid-19 issue. If the shoot is canceled by the customer due to covid-19 or for any valid reason, a credit voucher for the deposit amount will be granted. This voucher can be used for any session with us and is valid for six months.

Postponement:

​

The Studio will try to accommodate rescheduled sessions once. Any such changes must be communicated verbally to the studio at least 6 days prior to the shoot date so that any required adjustments may be made and time slots can be allocated to clients on the waitlist. The studio will, if possible, facilitate the session on the date based on the client's request subject to Studio/photographer availability.

Note, If a customer fails to cancel and does not show up for the reservation, the deposit will be forfeited.

Exclusive Photographer:

​

No photography of any kind is permitted by the client or anyone who comes with the client during sessions held in the studio or outdoor. All sessions will be carried out by the studio's qualified photographer.

Rights for Personal Usage Only:

​

All captured images are still the Studio's property. The Client is allowed to print copies of the Studio's images for their own personal non-commercial use as well as to give to friends and family. Images may be used on personal websites as long as a copyright notice identifying the Studio as the photographer is present next to the images. The client is not permitted to sell the pictures or enter them in a competition. If images are to be used for commercial purposes, commercial and corporate clients must notify the studio for clearance.

Intellectual Property (Copyright, amongst others):

​

The studio is free to display and utilize the photos it has taken for advertising, display, website and internet promotion, photo competitions, trade shows, open displays in malls, photography instruction books, books on photography, storefronts, window displays, studio displays, television and magazine advertisements, all digital marketing platforms, and any other use it deems appropriate for the promotion of its products and services. Unless the Client has made a written request for privacy prior to the Shoot, in which case the Studio may not use such photos of the Client for publicity, promotion, or presentation purposes, the Client releases the Studio and its legal representatives and assigns from all claims and liability relating to said photographs. In the unlikely event that photographs of the Client who has made a request for privacy are used before said public usage, the Studio is released from all claims and liability relating to said photographs.

Weather contingency:

​

In the event that an outdoor session is canceled due to inclement weather, a studio session will be substituted, and any difference in package prices will not be refunded.

Inherent Qualities: 

​

Client understands that color dyes in photographs and other print media may fade or discolor over time due to the inherent characteristics of dyes and environmental factors that may deteriorate due to delamination and oxidation, and Client releases the Studio from any liability for claims of any kind based upon the deterioration due to such inherent characteristics.

Service Description:

​

Our photo post-production editing service involves editing and enhancing photographs provided by the client.

The typical editing process may include color correction, retouching, cropping, and other enhancements as requested by the client.

 

Turnaround Time:

 

The standard turnaround time for photo post-production editing is 14 to 20 working days, starting from the date of receiving the selected photographs from the client.

Working days exclude weekends and public holidays.

We will make every effort to complete the editing within the specified timeframe, but we do not guarantee delivery on a specific date.

 

Rush Orders:

 

If the client requires expedited editing services with a shorter turnaround time than specified in the above clause, additional fees may apply. The availability of rush orders is subject to our capacity and workload.

Non-guarantee:

​

Although every effort will be made to capture images of all significant and unique occurrences throughout the Shoot, the Photographer is unable to provide an absolute guarantee on the aforementioned. The Studio disclaims all liability for any damaged photos brought on by inclement weather, people refusing to cooperate during the Shoot, or other circumstances beyond the Studio's reasonable control.

Privacy Policy & Data Collection:

​

The data controller, Studio, collects your personal information in compliance with Industry. All mandatory fields are denoted by an asterisk. Processing your request will not be possible if any required fields are left empty. Your personal information is gathered in order to fulfill your request. You have the right to view, modify, and delete your data. You also have the right to object to or restrict how your data is processed.

​Miscellany: 

​

These Terms and Conditions contain the complete agreement between the parties. Any modifications will be disclosed here and made public. Any waiver of a breach or default hereunder shall not constitute a waiver of any subsequent breach or default hereunder or under any other agreement. Before the booking deposit is paid, any differences or revisions must be agreed with in writing.
